Welcome to MoCo Media. These Terms and Conditions apply when you visit mocomedia.me, create an account, place an order, download a digital product, or otherwise use this website.

Throughout these terms, “MoCo Media,” “we,” “us,” and “our” refer to MoCo Media. “You” and “customer” refer to the person using the website or placing an order.

By using this website or completing a purchase, you agree to these Terms and Conditions, our Privacy Policy, and our Refund and Returns Policy. Please review them before placing an order.

1. Scope of These Terms

These terms apply only to purchases made directly through mocomedia.me.

Purchases made through Etsy, eBay, an in-person market, or another third-party marketplace may be governed by that platform’s terms, payment procedures, and return policies.

2. Eligibility and Website Use

You must be legally able to enter into a purchase agreement or have permission from a parent or legal guardian.

You agree not to use this website:

• For unlawful or fraudulent purposes
• To interfere with the website’s operation or security
• To submit false account, billing, or payment information
• To copy, scrape, reproduce, or commercially exploit website content without permission
• To attempt unauthorized access to customer, order, payment, or administrative information

We may suspend or cancel access when we reasonably believe the website is being misused.

3. Products and Descriptions

We make reasonable efforts to describe and photograph products accurately. However, colors and details may appear differently depending on lighting, photography, screen settings, and the device used to view the website.

Measurements are approximate unless a listing specifically states otherwise.

Many MoCo Media products are vintage, handmade, repurposed, one of a kind, or produced in small quantities. Natural variation, signs of age, minor irregularities, and evidence of handwork may be part of an item’s character rather than defects.

Please review the complete product description, photographs, dimensions, materials, condition notes, and other listing details before purchasing.

4. Vintage and Pre-Owned Items

Vintage and pre-owned products are sold in the condition described in their listings.

Normal signs of age may include:

• Surface wear
• Patina or tarnish
• Fading or discoloration
• Minor scratches
• Manufacturing variations
• Wear to packaging
• Other age-related characteristics

Known material flaws or significant damage will be disclosed when identified. Customers should not expect vintage items to appear or perform exactly like newly manufactured goods unless the listing says otherwise.

5. Handmade and Original Artwork

Original paintings, fabric creatures, jewelry, mixed-media work, and other handmade objects may contain small variations or irregularities created through the artistic process.

Unless expressly stated otherwise, purchasing an original artwork or handmade object transfers ownership of the physical item only. Copyright and reproduction rights remain with the artist.

The buyer may display, gift, or resell the physical item but may not reproduce, manufacture, publish, license, or commercially distribute the artwork or design without written permission.

6. Fabric and Textiles

Fabric listings will identify the available cut, width, fiber content, condition, designer, manufacturer, or collection whenever that information can be reasonably verified.

When multiple units of yardage are purchased, we will generally provide one continuous cut when inventory allows. A continuous cut is not guaranteed unless the listing specifically promises one.

Minor differences in measurement, dye lot, print placement, selvage, and color appearance may occur. Vintage, deadstock, destash, and remnant fabric may show storage folds, age-related characteristics, uneven edges, or other conditions described in the listing.

Fabric cut to a customer’s requested length is subject to the restrictions described in our Refund and Returns Policy.

Customers are responsible for determining whether a fabric is appropriate for a particular sewing, quilting, apparel, upholstery, or craft project.

7. Digital Products

Digital products are delivered electronically. No physical product will be shipped unless the listing expressly says otherwise.

Unless a product listing provides different terms, digital purchases include a limited, nonexclusive license for the buyer’s personal, noncommercial use.

You may not:

• Resell or redistribute the original digital files
• Share purchased files with others
• Upload the files to another marketplace, website, or file-sharing service
• Claim the artwork or design as your own
• Use the files to create products for commercial sale without written permission
• Convert, trace, or alter the files for resale or redistribution

Access to digital products may be revoked when an order is refunded, reversed, disputed, or determined to involve fraud or misuse.

Because digital files cannot be physically returned, additional restrictions apply after a file has been accessed or downloaded. Please review our Refund and Returns Policy before purchasing.

8. Orders

Submitting an order does not guarantee that it will be accepted.

We may cancel or refuse an order for reasons including:

• An item is unavailable or was sold elsewhere
• Product or pricing information contains a material error
• Payment cannot be authorized
• Shipping information is incomplete or invalid
• The order appears fraudulent or abusive
• The order violates these terms
• We cannot legally or practically fulfill the order

When we cancel a paid order, we will refund the amount collected for the cancelled items.

9. Prices, Payment, and Taxes

Prices are displayed in U.S. dollars unless otherwise stated.

Prices, promotions, shipping charges, and product availability may change without notice. Changes will not affect an order that has already been accepted unless the customer agrees to the change.

Payment must be completed through one of the payment methods offered at checkout. Payment information is processed by our payment service providers and is not stored directly by MoCo Media in complete card-number form.

Applicable sales tax will be calculated and collected when required.

If a product is listed at an obviously incorrect price because of a typographical, technical, or administrative error, we may contact you for approval of the corrected price or cancel and refund the order.

10. Shipping and Delivery

MoCo Media currently ships to eligible addresses within the United States.

Shipping charges, available methods, and free-shipping qualifications are shown during checkout. Delivery estimates are estimates rather than guarantees.

Customers are responsible for providing a complete and accurate shipping address. Additional shipping charges caused by an incorrect or incomplete customer-provided address may be the customer’s responsibility.

We will ship within the timeframe stated on the website, product listing, or order communication. If an unexpected delay prevents us from meeting that timeframe, we will contact you with the available options, including cancellation and refund when applicable.

Once an order has been transferred to the carrier, delays caused by weather, transportation interruptions, carrier operations, or other circumstances outside our reasonable control may affect delivery.

Contact us promptly if tracking shows that a package is lost, damaged, or delivered but cannot be located.

11. Returns, Refunds, and Exchanges

Returns and refunds are governed by our separate Refund and Returns Policy, which is incorporated into these terms.

Customers should contact admin@mocomedia.me before returning any item.

Nothing in these terms limits rights or remedies that cannot legally be waived, including applicable rights concerning defective or materially misrepresented goods.

12. Product Availability

Many products are unique, vintage, handmade, discontinued, or available in limited quantities.

An item may occasionally sell through another channel before website inventory can be updated. If an unavailable item is purchased, we will cancel that portion of the order and issue a refund.

We do not guarantee that sold-out products will be restocked.

13. Accounts

Customers may purchase as guests or create an account when those options are available.

You are responsible for:

• Providing accurate account information
• Protecting your password and login credentials
• Restricting unauthorized access to your account
• Notifying us if you believe your account has been compromised

We may close accounts that are fraudulent, abusive, inactive, or used in violation of these terms.

14. Reviews and Customer Content

Customers may be permitted to submit product reviews, photographs, comments, or other content.

Submitted content must be truthful, relevant, and lawful. It must not contain threats, harassment, spam, private information, malicious code, or content that infringes another person’s rights.

We may moderate or remove content that violates these standards.

15. Intellectual Property

The website and its original content, including artwork, photographs, illustrations, graphics, written copy, logos, product descriptions, digital files, and other creative material, are owned by MoCo Media, Julie Moser, their respective creators, or authorized rights holders.

No website content may be reproduced, republished, distributed, modified, sold, or used commercially without permission, except as allowed by an individual product license or applicable law.

References to third-party brands, designers, manufacturers, and product names are used for identification and descriptive purposes. Their appearance does not necessarily imply sponsorship or endorsement.

16. Third-Party Services and Links

The website may use or link to third-party services, including payment processors, shipping carriers, social media platforms, analytics services, and marketplaces.

Those services operate under their own policies and terms. MoCo Media is not responsible for the independent content, availability, security, or practices of third-party websites and services.

17. Disclaimer and Limitation of Liability

We provide the website and its content on an as-available basis.

To the fullest extent permitted by law, MoCo Media is not liable for indirect, incidental, special, or consequential losses arising from use of the website, inability to access the website, misuse of a product, or reliance on website content.

Our total liability relating to a product order will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires otherwise.

Nothing in this section excludes liability or consumer rights that cannot legally be excluded or limited.

18. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By placing an order, you authorize us and our service providers to use the information reasonably necessary to process payment, prevent fraud, fulfill the order, communicate with you, provide customer service, and meet legal and accounting obligations.

19. Changes to These Terms

We may update these Terms and Conditions as the business, website, products, or legal requirements change.

The effective date at the top of the page identifies the latest version. Changes apply to future website use and orders placed after the updated terms are published.

20. Governing Law

These terms are governed by the laws of the State of Maine and applicable federal law, without depriving customers of mandatory consumer protections that apply in their place of residence.

If one part of these terms is found invalid or unenforceable, the remaining provisions will continue to apply.
